This Privacy Statement describes how we collect, process, utilize, disclose, and safeguard information about you. It also shows you how to access and update your information, as well as make decisions about how your information is used.
The Privacy Policy applies to both "online" and "offline" (e.g., web and mobile services, including any websites operated by us such as https://www.Apni Cabi.com/ or Mobile Application, however accessed and/or used, whether via personal computers, mobile devices, or otherwise) activities owned, operated, provided, or made available by the Company. Our "online" and "offline" activities relating to the facilitation of taxi hiring services via a network of third party drivers and taxi operators are referred to collectively as the "Services."
This Privacy Policy also applies to your use of interactive features or downloads that we own or manage, are available through Apni Cabi's Services, or interact with the Services and post or incorporate this Privacy Policy.
YOU AGREE TO THE TERMS OF THIS PRIVACY POLICY BY ACCEPTING THE CUSTOMER TERMS AND CONDITIONS. Please read the following information carefully to ensure that you understand our privacy standards. Do not accept the Customer Terms and Conditions or use our Services if you do not agree to this Privacy Policy. The Customer Terms and Conditions incorporate this Privacy Policy by reference.

1. DEFINITIONS
Unless otherwise specified in this Privacy Policy, the terms capitalized in this Privacy Policy shall have the following meanings:
- The term "Co-branded Services" shall have the meaning accorded to it in point 4(3) of this agreement.
- "Device" refers to a computer, mobile device, or other device used to access the Services.
- "Device Identifier" refers to the Device's IP address or other unique identifier.
- "Mobile Application" refers to the application that we provide on the Device to access the Services.
- The term "Mobile Device Information" shall have the meaning granted to it in paragraph hereto.
- "ACEM" shall mean Apni Cabi Electric Mobility, a company incorporated under the Companies Act, 2013 and having its corporate office at________________________________, which expression shall be deemed to mean and include all our successors, affiliates, and permitted assigns, unless the context or meaning thereof requires otherwise.
- "Promotion" refers to any contests or other promotions that we may offer.
- "Protected Information" refers to information that could fairly be used to identify you personally, such as your name, e-mail address, and mobile phone number.
- "TPSP" refers to a third-party service provider.

2. WHAT PERSONAL INFORMATION DO WE COLLECT?
- THE INFORMATION YOU PROVIDE US
We may request specific Protected Information from you. We may collect this information through the Services in a variety of ways and places, such as account registration forms, contact us forms, or when you otherwise engage with us. You create a user profile when you sign up to utilize the Services. We will ask you to give only Protected Information that is required to be collected by us for a lawful reason related to our Services. The following are the current data fields that may be requested:

- Address
- Phone Number

- INFORMATION WE COLLECT AS YOU ACCESS AND USE OUR SERVICES
We and our TPSP may use a variety of technologies that automatically (or passively) collect certain information whenever you visit or interact with the Services ("Usage Information"). This Usage Information may include, among other things, the browser you are using, the URL that referred you to our Services, all of the areas of our Services that you visit, and the time of day. Furthermore, we gather the Device Identifier for your Device. A Device Identifier is a number that is automatically assigned to your Device when you use it to access the Services, and this number is used by our systems to identify your Device by a device identifier.
- When booking through the contact center, Apni Cabi reserves the right to record calls and chat histories for quality and training purposes.
- If you book a vehicle through 'Apni Cabi Cars,' we may collect your vehicle preferences, preferred address for test drives, car insurance details, purchase history, and information pertaining to the service package purchased, as well as any additional documents that you may have shared with us, in order to facilitate such sale/purchase of vehicle(s).
- Tracking information, including but not limited to geographic areas, is gathered when you browse across our Services. During the ride, the driver's phone will submit your GPS locations to our servers. Most GPS-enabled mobile devices can pinpoint a user's exact location to within 50 feet.
- If you request services through the 'Apni Cabi Foundation' or other Apni Cabi CSR activities, we may collect additional information, which may include sensitive personal information, such as medical reports and other documentary evidence, to validate the authenticity of your request for such services.
- If you add an emergency contact (name and phone number) to your account or the Mobile Application, we will collect and store that information to share your ride details with that contact and for use in an emergency situation.
- When booking through the contact center, Apni Cabi reserves the right to record calls and chat histories for quality and training purposes.
- If you book/purchase a vehicle through 'Apni Cabi Cars,' we may collect your vehicle preferences, preferred address for test drives, car insurance details, purchase history, and information pertaining to the service package purchased, as well as any additional documents that you may have shared with us, in order to facilitate such sale/purchase of vehicle(s).
- If you recommend a friend to our services, we will collect and store such contact information (name and phone number) in order to contact and promote our services to your friend.
- If you use your account to book a cab ride for someone else on your contact list via the Services, we will collect and store that contact information and communicate the ride details with that person.

- A cookie may be used to collect usage information. If you do not want information collected via cookies, your browser will allow you to deny or accept the use of cookies. Cookies can be disabled or restricted by changing the settings in your web browser or on your device. If you disable cookies or flash cookies on your Device, some aspects of the Services may not function properly or may be unable to customize information delivery to you. The Company has no control over third-party cookie use (or the resulting information), and third-party cookie use is not covered by our Privacy Policy.
- INFORMATION PROVIDED BY THIRD PARTIES ABOUT YOU
We may supplement the information we acquire about you through our website, Mobile Application, or Services with third-party records from time to time.

DATA COLLECTED BY MOBILE APPLICATIONS
Our Services are largely delivered via the Mobile Application. We may collect and use technical data and related information, such as technical information about your device, system and application software, and peripherals, that is collected on a regular basis to facilitate the provision of software updates, product support, and other services to you (if any) related to such Mobile Applications.In addition to the Device Information, when you use any of our Mobile Applications, the Mobile Application may automatically collect and retain any or all of the following information from your mobile device ("Mobile Device Information"), including without limitation:
- Your desired language and (if applicable) country site
- The brand and model of your mobile device
- Your smartphone's operating system
- Your geolocation Information about how you interact with the Mobile Application and any of our web sites to which the Mobile Application links, such as how many times you use a specific part of the Mobile Application over a given time period, the amount of time you spend using the Mobile Application, how frequently you use the Mobile Application, actions you take in the Mobile Application, and how you engage with the Mobile Application.
- Data from SMS/text messages received upon receiving Device permissions for the purposes of (i) issuing and receiving one-time passwords and other device verification, and (ii) automatically filling verification details during financial transactions, either through us or a third-party service provider, as required by applicable law. We do not share or transfer SMS/text message data to other parties except as specified in this Privacy Policy.
- DATA COLLECTED THROUGH TPSP ADVERTISING ON THE APNI CABI WEBSITE OR MOBILE APPLICATIONS
Apni Cabi's website or mobile application may have advertised TPSP services/products.
3. USE OF COLLECTED INFORMATION
- Our major purpose in collecting your information is to provide you with a better experience when using the Services. We use your information to closely monitor which features of the Services are most frequently used, to allow you to view your trip history, rate trips, and to determine which features need to be improved, including usage patterns and geographic locations to determine where we should offer or focus services, features, and/or resources.We will send you a greeting email to verify your username and password based on the Protected Information you offer us when registering for an account.
- We utilize the information gathered from our Mobile Application to provide you the appropriate app version based on your device type, for debugging, and in rare situations, for marketing purposes.
- We use your Internet Protocol (IP) address to assist diagnose computer server problems and to administer our website(s). Your IP address is used to help identify you but contains no personally identifiable information.
- We will only send you service-related announcements on rare occasions when it is essential. For example, if our Services are briefly unavailable due to maintenance, we may send you an email. If you do not want to receive them, you can deactivate your account.
- We may use the information we collect from you to prevent, detect, and investigate violations of this Privacy Policy or any applicable terms of service or conditions of use for the Mobile Application, as well as to investigate fraud, chargebacks, and other issues.
- We share some of your Protected Information (such as your name, pick-up address, and contact number) to the driver who accepts your transportation request/the associate who brings your desired car for a test drive so that the driver can contact and locate you. Companies that employ drivers (and so provide transportation services) have access to your Protected Information, including your geo-location data.
- We also share your information with any other users who will be traveling with you in the vehicle assigned to you, should you choose any pooled vehicle feature of our Services.
- We use that geo-location information for a variety of purposes, including allowing you to view drivers in your area who are close to your location, allowing you to set your pick-up location, allowing the drivers to identify the pick-up location, sending you promotions and offers, and allowing you (via any features we may provide) to share this information with others.
- In addition, we may use the Protected Information or Usage Information we collect about you to: (1) provide you with information or services or process transactions that you have requested or agreed to receive, such as sending you electronic newsletters, or to provide you with special offers or promotional materials on behalf of us or third parties; or (2) to enable you to participate in a variety of Services features, such as online or mobile entry sweepstakes contests or other promotions . (3) to contact you about your use of the Services and, at our discretion, changes to the Services and/or the policies governing the Services; (4) for internal business purposes; (5) for inclusion in our data analytics; and (6) for other purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.
- If you choose to use any of the services offered by ACEM/third parties on the Mobile Application, we may share the information we acquire from you with them. We may use the information we receive from you to target advertisements to you. This entails leveraging information gathered from an individual's web or mobile browsing habits, such as pages visited or queries performed. This data is subsequently utilized to determine which advertising should be shown to a certain individual on websites other than our website(s). The information gathered is only connected to an anonymous cookie ID (alphanumeric number); it does not include any information that may be used to identify a specific person, such as their name, address, or email address and credit card number.
4. WHEN AND HOW DO WE PROVIDE INFORMATION TO THIRD PARTIES?
Other than as described in this Privacy Policy or at the time you provide your information, we do not sell, distribute, rent, or trade the information we have acquired about you. The following are examples of scenarios in which information may be shared:
1. WHEN YOU AGREE TO RECEIVE INFORMATION FROM THIRD PARTIES.
You may be given the option to receive information and/or marketing offers from third parties directly. If you opt to share your Protected Information, your Protected Information will be disclosed to such third parties, and all information you disclose will be subject to such third parties' privacy policies and practices. We are not responsible for the privacy policies and practices of such third parties; thus, before opting to receive such information from them, you should evaluate their privacy policies and practices. If you later decide that you no longer wish to hear from a third party, you must contact that third party directly.
2. THIRD PARTIES PROVIDING SERVICES ON OUR BEHALF
We use third-party companies and individuals to facilitate our Services, provide or perform certain aspects of the Services on our behalf - such as drivers and the companies for which they work to provide the Services, other third parties including ACEM to host the Services, design and/or operate the Services' features, track the Services' analytics, process payments, engage in anti-fraud and security measures, and provide customer support. Third parties will have access to user data, including Protected Information to only do the services you or we have hired them to do. Each of these third parties, including ACEM, is expected to maintain the same level of data security as we do and is not permitted to divulge or use Protected Information for any other reason.
TPSPs may place and access their own cookies, web beacons, and embedded scripts on your Device, as well as collect or access information about you, including non-personally identifiable information. Our website's assistance section is hosted by a third-party hosting company. Our Privacy Policy governs information collected by such third parties on this section of our website.
3. CO-BRANDED SERVICES
Certain features of the Services may be given to you in collaboration with third parties ("Co-Branded Services"), such as sponsors and charities, and may necessitate the disclosure of Protected Information to them. The third party shall be identified by such Co-Branded Services. If you want to register for products and/or services through the Co-Branded Services, you agree to share your information with both us and the third party. Furthermore, if you use a username and password obtained through our Services to sign in to a Co-Branded Service, your Protected Information may be revealed to the listed third parties for that Co-Branded Service and will be subject to their posted privacy policies.
4. CONTESTS AND PROMOTIONS
Through the Services, we may provide Promotions that require registration. By taking part in a Promotion, you agree to the official rules that govern that Promotion, which may include particular requirements of you, such as authorizing the Promotion's sponsor to use your name, voice, and/or likeness in advertising or marketing related to the Promotion. If you choose to enter a Promotion, you agree that your Protected Information may be disclosed to third parties or the public in connection with its administration, including winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners list.
5. ADMINISTRATIVE AND LEGAL REASONS
We collaborate with government and law enforcement personnel, as well as private parties, to enforce and comply with the law. As a result, we may access, utilize, store, transfer, and disclose your information (including Protected Information, IP address, Device Information, or geo-location data) as we reasonably deem is necessary and appropriate to Government or law enforcement officials or private parties: (i) to comply with any applicable law, regulation, subpoenas, Governmental requests, or legal process; (ii) to protect and/or defend the Terms and Conditions for online and mobile Services or other policies applicable to any online and mobile Services, including investigation of potential violations thereof; (iii) to protect the safety, rights, property, or security of the Company, our Services, or any third party; and (iv) to safeguard the public's safety for any reason; (v) to identify, prevent, or otherwise resolve fraud, security, or technical issues; and/or (vi) to prevent or stop activity that we believe is, or may be, unlawful, unethical, or legally actionable.
6. WHEN YOU SHARE INFORMATION
Protected Information may be collected and shared with third-parties if you specifically and knowingly upload, share with, or transmit content from the Mobile Application to an email recipient, online community, website, or to the public, e.g. uploaded photos, posted reviews or comments, or information about you or your ride that you choose to share with others through features that may be provided on our Services. This content will also be subject to the privacy policies of the email, online community website, social media platform, or other platform to which you post, share, or transmit the content.
7. BUSINESS TRANSFER
We may share your information, including your Protected Information and Usage Information, with our parent, subsidiaries, and affiliates for internal purposes such as commercial and operational reasons. We also reserve the right to disclose and transfer all such information in the following circumstances: (i) to a subsequent owner, co-owner, or operator of the Services or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our membership interests and/or assets, or other corporate change, including during any due diligence process.
8. MARKET STUDY AND OTHER BENEFITS
We may share your information, including your Protected Information and Usage Information, with third parties for any reason, including but not limited to market research/study, data analysis, determining and customizing product or service offerings, improving the products or Services, or making any other benefits/products/services available to you.
9. WITH THE OWNER OF APNI CABI ACCOUNTS THAT YOU MAY USE
If you use an account or profile linked with another party, we may share the trip data with the owner of the profile.
This may happen:
- if you use your employer's profile under a corporate arrangement;
- if you take a trip planned by a friend.
5. THIRD PARTY CONTENT AND LINKS TO THIRD PARTY SERVICES
- The Services may contain third-party content and links to third-party services, and such third parties may collect website usage information and your Device Identifier when web pages from any online or mobile Services are provided to your browser. Furthermore, while using the Services, you may be routed to other sites or applications managed and controlled by third parties over whom we have no control.
- We are not liable for the privacy practices of any of these third parties. For example, if you click on a banner advertisement, you may be sent away from one of our websites and to another. These other websites may send you their own cookies, gather data or solicit Protected Information independently, and may or may not have their own declared privacy policies. We encourage you to take note of when you leave our Services and to read the privacy policies of all third-party web sites or applications before disclosing any Protected Information to third parties.
6. SOCIAL MEDIA FEATURES AND WIDGETS
- Social media elements, such as the Facebook Like button, and widgets, such as a "Share This" button, or interactive mini-programs that run on our online and mobile Services, may be included in our online and mobile Services. These features may gather your IP address, photograph, which page of our online or mobile Services you are visiting, and may establish a cookie to enable the feature to function properly. Social media tools and widgets are hosted either by a third party or directly on our online Services. The privacy policies of the companies that provide these tools and widgets control your interactions with them.
7. INFORMATION COLLECTED BY DRIVERS
- This Privacy Policy does not apply to the use of any information about you collected by the driver or the firm to which the driver belongs while providing you with a trip on a cab booked via the Services, or otherwise, that is not given by us.
8. CHANGE OF INFORMATION AND CANCELLATION OF ACCOUNT
- You are responsible for keeping the information you submit to us, such as your contact information supplied during account registration, up to date. If your Protected Information changes, or if you no longer want our Services, you can alter it on our member information page or contact us using the email address listed on our website or Mobile Application. We shall make reasonable attempts to implement requested changes in our currently operating databases as soon as reasonably possible.
- You can also cancel or change the messages you have chosen to receive from the Services by following the instructions in an e-mail or by login into your user account and adjusting your communication preferences.
- If, after modifying or changing the information previously provided to Us, we find it difficult to grant you access to our Services due to inadequacy/inaccuracy of the information, we may, in our sole discretion, terminate your access to the Services by sending you a written notice to that effect to your registered email id.
- If you wish to cancel your account or request that we no longer use your information to provide you services, contact us through email address mentioned on the trip bill received. We will retain your Protected Information and Usage Information (including geo-location) for as long as your account with the Services is active and as needed to provide you services. Even after your account is closed, we will keep your Protected Information and Usage Information (including geo-location, trip history, and transaction history) as needed to comply with our legal and regulatory obligations, resolve disputes, complete any activities related to account cancellation, investigate or prevent fraud and other inappropriate activity, enforce our agreements, and for other business reasons. After a period of time, your data may be anonymized and aggregated, and we may retain it for as long as necessary to operate our Services successfully, but we will only use the anonymized data for analytic reasons.
9. Offering account deletion in your app
Starting June 30, 2022, apps submitted to the App Store that support account creation must also let users initiate deletion of their account within the app. Deleting an account removes the account from the developer’s records, along with any data associated with the account that the developer isn’t legally required to maintain. Providing this capability gives people more control of the personal data they’ve shared. If you’re updating an app or submitting a new app with account creation, please read the guidance below to prevent delays in review.
10. Account deletion guidance
Account deletion is a significant decision for the user, and the process for initiating and confirming deletion should be straightforward and transparent:
- Make the account deletion option easy to find in your app. Typically, it’s included in the app’s account settings.
- Offer to delete the entire account record, along with associated personal data. You may include additional options, but only offering to temporarily deactivate or disable an account is insufficient.
- If people need to visit a website to finish deleting their account, include a link directly to the page on your website where they can complete the process.
- Keep users informed. If the deletion request will take additional time to complete, let them know. If your app supports in-app purchases, help people understand how billing and cancellations will be handled. For additional guidance, read the Human Interface Guidelines.
Note: Follow applicable legal requirements for storing and retaining user account information and for handling account deletion. This includes complying with local laws where your apps are available. If you have questions regarding your legal obligations, check with your legal counsel.
11. SECURITY
- The Safeguarded Information and Use The information we gather is safely stored in our databases, and we protect it with industry-standard, commercially reasonable security procedures such as encryption, firewalls, and SSL (Secure Socket Layers). However, no security system is impenetrable, no matter how effective encryption technology is. We cannot guarantee the security of our databases, nor can we guarantee that information you provide will not be intercepted while being conveyed to us via the Internet or wireless transmission; any information you communicate to the Company is done at your own risk. We advise you not to reveal your password to anyone.
12. GRIEVANCE OFFICER
- Apni Cabi hereby appoints Apni Cabi Support Manager as the grievance officer for the purposes of the Information Technology Act, 2000, who may be reached at support@Apni Cabi.com. You may address any concerns you have about this privacy policy or the use of your Protected Information or other data to him.
13. CHANGES TO THE PRIVACY POLICY
- We may update this Privacy Policy from time to time to reflect changes in our information practices. Any modifications will take effect soon once the new Privacy Policy is posted. If we make any major changes, we will notify you via email (sent to the e-mail address indicated in your account) or a notice on the Services before the change takes effect.
